Safety and Labeling: DSHEA requires dietary supplement manufacturers to ensure that their products are safe and accurately labeled. Manufacturers must provide accurate ingredient lists and nutrition labeling, and they are responsible for evaluating the safety of their products before marketing them.

Navigating Special Sensitivity Categories

While it’s important to stay respectful to the FDA and follow supplement copywriting guidelines across all products, I have noticed that certain supplement categories require heightened vigilance due to their profound impact on health. These categories encompass:

  • Inflammation – Do not talk about anything being anti-inflammatory. It is better to put this in the context of immune modulation, if anything.
  • Pain – It is better to talk about soothing comfort than to talk about pain relief. That market is cornered by OTC and Big Pharma.
  • Immune boosting – This category has always been sensitive. Since COVID, it’s now 10X more sensitive than ever before. Immune support requires special care. I have expertise as an immune supplement copywriter.
  • Cholesterol lowering – Extremely sensitive since a red yeast rice debacle about 20 years ago. Maybe your product can help to maintain healthy cholesterol levels already within normal range. Maybe.
  • Blood pressure reduction – Similar to cholesterol in the cardiovascular wellness sphere; maybe your product can help to maintain blood pressure that’s already within normal range, but if you claim to help lower blood pressure, you are asking for trouble.

When marketing products in these categories, exercise extreme caution and ensure that every claim is solidly backed by scientific evidence. Avoid any form of exaggeration or unsupported assertions that could attract unwanted regulatory attention.

Special note on cancer: You should never, ever market a product for cancer. It is probably the biggest red flag the FDA will look for, and believe me, they will come down on your company HARD if you cross that line. Just don’t do it! It is irresponsible and a disservice to both consumers and the supplement industry as a whole.

What about FDA Qualified Health Claims?

Supplement Copywriting Guidelines: Mistakes to Avoid!

Never mention diseases.

This goes beyond cancer. As soon as  you mention a disease in the context of your supplement, you are violating all sorts of regulations. Just don’t do it. You can instead dance around diseases and conditions by alluding to them in a vague way that will remain respectful to the FDA and FTC. One example would be to talk about “mild and occasional joint discomfort” rather than directly talking about osteoarthritis.

Never go into PTC: Prevent, Treat and Cure.

I recently saw immune supplement marketing that talked about preventing and curing sickness. Yikes! I almost had a heart attack. It’s risky enough that to use” prevent” and “cure”, but to put it in the context of an extremely sensitive category these days — immune function — amplifies the risk significantly.

Never be deceptive or misleading.

The FDA and FTC want you to be “truthful and not misleading.” It is a reasonable request. But so many companies ignore this simple ask, raising their risk of landing on regulatory bodies’ radar. I have an example: I recently saw some multivitamin copy that said 95% of Americans are facing serious health problems due to essential nutrient deficiencies. This is inaccurate. A closer estimate is up to 10% of Americans are deficient in an essential nutrient.

The USA is a first-world country where enriched and fortified foods are widely available, and malnutrition is extremely rare. So how might the USDA, FDA and FTC react to marketing suggesting most Americans have nutritionally deficiency-? All would regard this as “untruthful and misleading,” potentially placing a company squarely in their crosshairs.

Never mention drugs.

The DSHEA act we discussed earlier established that supplements and drugs are completely different. Pharmaceuticals require extensive research prior to entering the market, but you can sell supplements right away. This distinction enables the supplement industry to exist and survive! Therefore, it is critically important to never mention a drug, never propose a supplement is an alternative to a drug, and never compare a supplement to a drug in your copy.

Strategies to Maintain Compliance

To write FDA compliant copy and stay respectful to FTC regulations while optimizing sales and brand reputation, consider implementing the following strategies:

During and after the COVID-19 pandemic, demand for immune supplements has surged. However, supplement companies must approach this opportunity with caution and responsibility. The FDA’s Scrutiny of COVID-19 Claims

In the world of dietary supplements, immune support products have always been a rather sensitive category. Even claims ranging from acute respiratory tract infections to the common cold would trigger major red flags in the eyes of the FDA.

As you can imagine, during COVID any FDA scrutiny of the dietary supplement market was massively amplified — and rightfully so.

With a pandemic in full effect, sadly (and predictably) many unscrupulous companies went into vulture mode and began marketing their nutritional supplements as products that could fight COVID.

To the FDA’s credit, they swung into action quickly. By January 1 of 2020, the FDA had issued 136 warning letters to dietary supplement companies for unapproved and misbranded products in the context of COVID-19 claims. These actions were justified to protect consumers from dangerous misinformation.

You can check out many of the FDA warning letters related to COVID on your own. And I highly recommend doing so. Reading risky claims first-hand is a great way to learn how to keep your own claims clean.

If you’re in a rush, I have created a quick random sampling you can check out in the list below, to get an idea of the herbal supplements and natural products that were making irresponsible immune claims.

GOOD FOR PREVENTION AND STRENGTHENING THE IMMUNE SYSTEM. . . . HIGHLY EFFECTIVE FOR ACTIVE COVID-19 PATIENTS.
  • “Corona virus treatment. We analyzed how corona viruses infect tissues, what tissues they infect, and the herbs that are useful to interrupt that process, as well as the herbs useful to shut down the cytokine cascade they create. Here is the protocol.… [T]his is a rather extensive protocol because the particular corona virus that is now spreading world wide is exceptionally potent in its impacts. All the herbs are specific in one way or another for this virus. A number of the herbs are strongly antiviral for corona viruses .…. The formulations are preventative as well as specific for acute infections ….”
  • “Each 100 ml of product will last 16 days for a preventative dose and 8 days for an infection dosage. . . .Take Extracts #1 through #3 as preventative. . . .If you are infected, take all 4 products and use the infection dosage.”
  • “If you are concerned about protecting your health and the health of those you love as the world is facing the continued spread of COVID-19, Chinese medicine may have much to offer that could be life-saving.”
  • “This Nano Silver 10 PPM is your totally non-toxic key to halting COVID-19 APR – Attachment, Penetration, and Replication – to keep yourself and those you love healthy.”
  • “‘AS CORONAVIRUS SPREAD SPEEDS UP, MONTREAL RESEARCHERS WILL TRIAL AN ANTI-VIRAL TREATMENT FOR COVID-19 IN CHINA’‘ Quercetin has already proven successful at treating Ebola and Zika viruses [in mammals].’”

Such claims were found across several different marketing channels, including company websites, promotional materials, social accounts, and with affiliate marketing programs and influencers.

The audacity of some of these companies is staggering.

First off, immune claims are sensitive in their own right. But to then combine sensitive claims with claims of prevention, treatment and conflating supplements with medicines… well it’s a bad strategy to say the least. These companies were practically begging for warning letters from the FDA!

It is interesting to me that the FDA really cast a wide net with these warning letters, too. While most were egregious, there were a few “mild” violations as well — a pretty clear message that the FDA is not tolerating any shenanigans whatsoever when it comes to the COVID space.

Market Immune Health, Not COVID-19

Don’t let FDA scrutiny scare you away from immune supplement marketing!

Immune health is a great category to be in, with tremendous promise for the future.

Research Nester says the immune supplements category will have CAGR of 7.5% and grow to a total market size of $28 Billion by 2028.

This dietary supplements research report was released before the pandemic, and should be considered a conservative estimate.

Moreover, there are so many great ingredients the dietary supplement market can offer to consumers that may help!

Avoiding Risk: How to market immune supplements safely

So what can you say? What can’t you say about immune supplements? And what kind of risks should you look out for?

First and foremost: Don’t mention COVID, the common cold, viruses, sickness of any kind ever!

 

Don’t say COVID-19.

COVID, coronavirus, COVID-19… whatever moniker you use in day-to-day life, avoid them in all your immune supplement marketing materials.

As soon as you mention the exact threat to your immune system, you are placing your dietary supplements in the context of “treating” whatever that threat may be.

Also avoid phrases like these:

  • Immune-booster
  • Anti-viral or viruses
  • Strengthen your defenses
  • Anti-inflammatory
  • Fighting viral infection
  • Serious illness

*So how can you say “sick” without really saying it? One of my favorite phrases to use to dance around the risky words is “immune challenges.”

Along those same lines, “seasonal immune challenges” alludes to cold and flu season without using the red-flag phrasing that gets other nutritional supplements manufacturers into trouble.

Safer claims to use:

  • Supports immune system function
  • Maintain your natural defenses
  • Promotes a balanced immune responses
  • Support healthy immune performance
  • Promote balanced immune responses

Use the best researched immune nutrients for your supplement to make the strongest claims.

To make the strongest immune health claims, focus your formulation on the best dietary supplement ingredients shown in research to help the body’s immune response.

There are many ingredients now found in immune support supplements that have been shown in clinical trials to optimize the adaptive immune response. In other words, supplements remain a great way to support the immune system… and consumers know it. Some of my favorites:

Vitamin and Mineral Supplements

So rather than nutritional supplements “boosting immune function,” we want to rather portray them as optimizing, promoting, supporting, maintaining, etc. the body’s immune response.

The same idea goes for the inflammatory aspects of immune system performance (which we can’t really talk about anyway). Nutritional supplements cannot have “anti-inflammatory” claims because they are very risky. To mitigate the risk, we rather suggest that a nutritional supplement may “modulate” or “regulate” inflammation.

Finally, it is also great to encourage new supplement takers to follow healthy lifestyle practices that are associated with immune function. These can include intake of citrus fruits, kefir and other immune-supportive foods in a balanced diet; weight loss efforts; stress reduction and more.

How to Write About Testosterone Supplements

If you’re getting ready to write up your T-booster dietary supplement, here are some words of advice for you — straight from a professional testosterone supplements copywriter!

The first is, you can’t treat testosterone supplements like other categories. Similar to supplements for cholesterol, for libido, and weight loss, testosterone is one of those very sensitive categories that requires special care.

It’s ironic; “testosterone booster” is in itself a risky name for a supplement. Because it implies that simply taking the pill will raise one’s testosterone levels. That’s exactly the kind of language you should probably be avoiding if you wish to minimize risk.

You’ll also want to avoid mentions of testosterone replacement therapy (TRT) because that is in a medical sphere, which must be kept completely separate from supplements.

The same goes for “alternative treatments” and marketing claims related to erectile function (as well as erectile dysfunction). Only prescription drugs can treat doctor-diagnosed, blood test verified testosterone problems.

Testosterone supplements claiming to treat low testosterone are asking for trouble!

This risk is amplified if a testosterone boosting supplement wades into the dangerous waters of erectile function claims. Just consider how popular drugs for erectile dysfunction are, how powerful the Big Pharma companies that produce them are, and ask yourself: “Do I really want to poke that bear?” It’s not worth it!

Now, if you want to keep your testosterone boosting supplement claims clean and conservative, you would use a different style of language. Some examples of safer claims include:

  • Helps to support healthy testosterone levels
  • Helps maintain testosterone production
  • Supports testosterone production
  • Supplies important nutrients for testosterone synthesis
  • Natural testosterone support

Sexy? Not really. Vague? Most definitely. But if you want to sell natural testosterone boosters on Amazon and remain in the good graces of the FDA and FTC, this is the tone you should aim for.

What to say: Testosterone, Test or T?

Great question. How should we refer to testosterone in supplement content? As a testosterone supplements copywriter, I have worked with quite a few  companies in this space, all of which had different takes on terminology.

One especially popular online testosterone supplement insisted on using “T” only in their content. I don’t agree with this.

Testosterone Supplement Copywriting Examples

In this section, I will start sharing some of the good stuff!

I will begin with some content marketing: A testosterone booster index. This is an example of educational content in the t-booster space. In it, I list many of today’s most popular test boosters.

But instead of just empty marketing words, this content is helpful: It gives consumers at-a-glance education on what these herbs, vitamins, minerals and other common ingredients are, how they work, and what they do.

The kicker: each claim is linked to a credible research source (the numbered references are listed at the bottom of this article).

As I alluded to earlier in this article, evidence is critical when it comes to the more sensitive and risky categories in the nutritional supplement space — so sharing this research is one of the key factors for building trust with your consumers while paying respect to the FDA, FTC, Amazon and other important bodies that are interwoven in supplement sales. Samples follow:

Testosterone Booster Index – Sample of Supplement Content Writing

T-booster supplements may supply a single ingredient or multiple ingredients. Single-ingredient products can deliver a higher dosage of individual supplement components per capsule, but mega-dosing is often a bad idea with T-booster compounds. Individual supplements can also get expensive if you want more than one nutrient in your T-boosting regimen.

More popular are T-booster complexes, which blend many vitamins, minerals and botanicals into one product. In complexes, some ingredients directly boost testosterone levels; others may work indirectly or even address other aspects of men’s vitality.

In general, the idea is that these ingredients will combine to help men conquer common low-T symptoms like fatigue, lost sex drive, weight gain, brain fog and more.

Complexes can be a cost-effective way to get several T-boosters and related compounds in one supplement. But the best formulas – and this might be the real secret – are made to be synergistic. This means ingredients’ individual effects are magnified by others in the formula, making the compounds more powerful combined than when taken alone.

Ingredients in T-booster supplements:

Horny Goat Weed: This flowering Asian plant got its name when a farmer noticed that his goats had more sex after eating it. Horny Goat Weed supplies an active ingredient called icariin that was shown in early animal research to raise blood T-levels.(1) This T-boosting activity might contribute to Horny Goat Weed’s more widely known reputation as a natural “sex enhancer.”

Tongkat Ali: Also called “Malaysian Gisnseng” this root has shown anti-estrogen effects in animal research.(2) One animal study also found that tongkat ali raised the testosterone level in the testes after 30 days of supplementation.(3) The evidence supporting in animal studies complements human research that showed tongkat ali may improve semen volume, sperm activity and male potency.(4)

Bulbine Natalensis: A traditional African herb, Bulbine has long been used by the Zulu for libido support. In tribal practices, powdered Bulbine stem would be mixed with milk to make a virility-enhancing drink.(5) Animal research suggests Bulbine might help testicular and blood T-levels, and seems to exhibit anabolic and androgenic activities.(6) Bulbine has been linked to liver risks.

DHEA: Dehydroepiandrosterone (DHEA) is made in the adrenal glands and migrates to the testes. Here, it serves as a raw material for T production. Evidence shows DHEA declines with age: 70-year-old men, who often have low testosterone, have about 80% less DHEA in their blood than younger men.(7) Although DHEA supplementation is somewhat controversial, research shows it boosts and sustains free testosterone circulating in the blood.(8)

Tribulus: An aphrodisiac in ancient Asian traditions, Tribulus terrestris is now popularly used by athletes for lean muscle mass. A spiky plant, tribulus is also reputed to “spike” testosterone levels; however, evidence in this area is early at best. One study found that combining tribulus with androstenedione, chrysin, indole-3-carbinol (I3C), and saw palmetto did appear to boost multiple androgen male sex hormones, including testosterone.(9)

L-DOPA: Also called levodopa, this botanical compound may boost levels of Luteinizing Hormone (LH), which stimulates the testes to make testosterone. One animal study found that a single high-dose serving of L-DOPA significantly raised LH levels after only four hours. Researchers concluded that prolonged high-dose L-DOPA appeared to be associated with sustained blood LH levels.(10)

Mucuna Pruriens: Also known as “velvet bean,” Mucuna is an Ayurvedic plant with seeds that are a rich in levodopa (L-DOPA). In a human study of male subjects with fertility problems, Mucuna supplementation was found to significantly increase testosterone and LH blood levels, while also improving dopamine, adrenaline and noradrenaline status. Researchers observed that Mucuna could help to improve male fertility, since it also enhanced both sperm count and sperm motility.(11)

Oysters: Rich in protein, oysters are also a good source many important minerals, including zinc, selenium, magnesium and iron. Oysters also deliver several B vitamins. Famous for sparking men’s sex drive, oysters have been suggested to be a T-boosting food – a reputation that’s probably backed by their zinc and B-vitamin nutrition.

B Vitamins: Animal research shows low Vitamin B6 levels are tied to low testosterone levels. Scientists have even suggested low B6 intake may actually slow testosterone synthesis.14 B12 is another B-vitamin that may appear in T-boosters for its energy metabolism benefits. B vitamins can be challenging: We need a higher daily intake of them as we grow older, but they also get harder to absorb with age.15 It’s a good idea to supplement with absorption-enhanced forms of B6 and B12 when possible.

Magnesium: This mineral sparks 300+ life-sustaining reactions in the body, including protein synthesis, bone formation, muscle relaxation and testosterone boosting. In one study of male volunteers, researchers found “supplementation with magnesium increases free and total testosterone.”16 It’s worth noting that older men who may be in T decline have a harder time absorbing and retaining magnesium.(17) Bioavailable mineral forms, such as magnesium citrate, may be helpful for these populations.

Zinc: An essential mineral for masculine health, zinc supports prostate function, sperm activity and reproductive potency in men. Zinc is used by the Leydig cells in the testes to produce testosterone. Human clinical trials have found that young men with low zinc intake have lower blood testosterone levels and less semen volume.(18) These study results provide evidence for zinc’s potential role in male virility. Zinc may be depleted in the aging male body, and is a first-line supplement for maintaining testosterone levels.

Nettle Urtica: Also known as “stinging nettle,” this traditional European herb is popularly used by mature men to support prostate health, urinary comfort and sexual function. Nettle might be good for the prostate because it blocks aromatase, an enzyme that turns testosterone into estrogen.(19) By blocking this conversion, nettle may help men keep their T-levels up and estrogen down, supporting an ideal manly ratio while assisting with urinary symptoms.

Siberian Ginseng: Also known as eleuthero, Siberian Ginseng is an “adaptogen” herb that strengthens the body’s resistance to stress. Only weak anecdotal evidence suggests Siberian Ginseng may raise T-levels in mice. Eleuthero’s presence in individual supplements and stacks is more likely related to its well-documented benefits for energy, mental sharpness, peak physical performance and stress resistance.(20)

Fenugreek: This ancient Indian spice is one of the oldest cultivated plants in the world. Research has suggested that a standardized fenugreek seed supplement improved sex drive and helped maintain peak blood testosterone levels.(21) Fenugreek has also been suggested to have anabolic muscle mass and stamina-enhancing effects that may help with other goals of testosterone boosting regimens.(22)

Vitamin D: Most Americans fail to get enough of the recommended daily allowance of this important vitamin, famous for supporting immunity and bone density. Paradoxically, we need more vitamin D with age, but it also gets harder to absorb and synthesize as we age. This might mean that many men are missing out on D’s T-boosting benefits: Human clinical research has shown regular D intake raises blood levels of free testosterone, bioactive T and total T.23 Look for the D3 form of the vitamin, which is easier to absorb.

D-Aspartic Acid: Also called DAA, this amino acid influences the production and release of hormones. Animal studies have suggested DAA triggers release of LH and growth hormone from the pituitary gland; in the testes, it promotes the formation and release of testosterone.24 DAA seems to be one of the more effective T-boosters, with a strong human study finding it raised testosterone levels by 160%.25 DAACC, which is the chelated form of DAA, may be easier for the body to absorb and utilize.

Luteolin: An antioxidant flavonoid, luteolin is found in many fruits and vegetables, as well as in Traditional Chinese Medicine herbs. Luteolin may be featured in T- boosters because it blocks the aromatase enzyme that converts testosterone into the female sex hormone, estrogen.26 Like nettle, luteolin helps men optimize T-levels and keep estrogen in check – which may help delay andropause and its related symptoms.

Boron: This mineral, popularly taken for bone strength and joint comfort, may also have testosterone benefits. One study found that boron raises T while significantly reducing estradiol, a female sex hormone related to estrogen. These results led researchers to proclaim it was “the first human study to show an increased level of free testosterone after boron consumption.”(27)

Vitamin K: Known for keeping calcium in the bones and out of the bloodstream, this essential vitamin is also found in the testes, where it promotes testosterone synthesis. Animal research has found that Vitamin K deficiency correlates with low testosterone production.(28) Vitamin K supplements appear to reverse this problem, boosting T-synthesis and helping restore healthy levels.(29) There are several vitamin K forms; K2 is believed to have the highest activity and strongest potency.

You may choose more aggressive marketing than this, but if you want to stay extremely conservative, that is more the tone you must take. As a bonus, consider pairing any “helps you lose weight” claims with a qualifier like “as part of a healthy diet and exercise program.”

While we’re at it, remember the importance of the word “helps.”

Olive Supplement Copywriting Example 1: Content Marketing Blog Article

Olea25™ Olive Hydroxytyrosol Hits Astonishing 68,000+ ORAC Antioxidant Value

The Mediterranean Diet is associated with heart health, beautiful skin, flexibility, youthfulness and longevity. In fact, Mediterranean populations—Greeks and Italians in particular—may have among the highest life expectancies and the lowest incidence rates of all-cause mortality in the world.1 Olives and olive oil, which are widely consumed among these populations, supply potent nutritional compounds that may help contribute to the remarkable health of Mediterranean citizens.

Traditionally, olives’ health-supportive activities were attributed to their content of oleic acid, also known as an Omega-9 fatty acid.2 However, some researches now suggest that olives’ health-promoting biological activities may be more attributed to polyphenols: Powerful inflammation-soothing antioxidant compounds that appear to promote health across many body systems:3

Polyphenols seem to hold great promise for wellness. And now, research is zeroing in one olive-sourced polyhenol in particular—hydroxytyrosol—because it seems to supply even greater nutritional support for both daily and long-term vitality. Hydroxytyrosol: The Most Important Phenol Ever Discovered?
Polyphenols are present in many fruits and vegetables. Hydroxytyrosol, however, is exclusively found in olives.4 In fact, hyroxytyrosol comprises 50% of the total phenolic content found in olives.   • Hydroxytyrosol, a tiny molecule that is fat- and water-soluble, appears to be rapidly absorbed, distributed and metabolized in animal tissues– so its antioxidant and inflammation-modulating biological activities can reach and support many different body systems.7
  • Due to its small molecular size, Hydroxytyrosol is also one of the few antioxidants that can cross the blood-brain barrier; its beneficial activities appear to extend to brain health.7

Here’s the challenge: Olives and olive oil are a source of hydroxytyrosol, but let’s face it, they are heavy, dense foods. In fact, just one ounce of olive oil contains 250 calories and over 28 grams of fat!8 Plus, one ounce wouldn’t be nearly enough to provide beneficial levels of hydroxytyrosol.

In a significant nutritional advancement, some supplement manufacturers are now isolating hydroxytyrosol from olives and presenting it as a standalone compound—enabling them to supply an intensive dosage without the calories and fat of dietary olives and olive oil. Cardiovascular Health
Research has shown that those who followed a Mediterranean-style diet, including intake of olives and olive oil, appeared to have a 50% to 70% lower risk of recurrent heart concerns when compared with those who followed a diet that closely matched the American Heart Association’s (AHA) Step–I diet.9

Hydroxytyrosol may contribute to this heart-healthy diet through a few mechanisms:

  • Hydroxytyrosol has been shown to strongly inhibit the oxidation of LDL (“bad”) cholesterol. Oxidized LDL is believed to raise risk for cardiovascular health concerns.10
  • Animal studies suggest hydroxytyrosol may help to maintain blood triglycerides and cholesterol levels already within normal range, while also promoting HDL (“good”) cholesterol levels.11
  • Hydroxytyrosol may help inhibit blood “stickiness” while blocking inflammatory signals that irritate blood vessels. These activities may support flexible arteries and clear circulation.12,13

Brain Health
Not all antioxidants can cross the blood-brain barrier, but hydroxytyrosol is capable of entering the brain.14 This means hydroxytyrosol can leverage its potent antioxidant activity within our gray matter, working to protect brain cells against the free radical-induced damage that has been implicated in a range of neurodegenerative conditions.15 Hydroxytyrosol has also been suggested to be especially effective at neutralizing peroxynitrite, a type of free radical that is believed to directly influence the onset of age-related cognitive decline.16

Joint Health
One animal study found that olive oil that was enhanced with hydroxytyrosol appeared to promote joint flexibility and comfort. In particular, the study suggested hydroxytyrosol seemed to reduce bone breakdown and bone spurs while soothing connective tissue swelling—biological activities that seemed to combine to promote healthy joint function. Researchers concluded that hydroxytyrosol may help with the acute and ongoing inflammation associated with joint aches and stiffness.17

Skin Health
UVB rays from sunlight can unleash free radicals in skin that may cause photodamage: “accelerated aging” changes seen in the appearance of wrinkles, fine lines, sagging and spotting. These skin changes may also be associated with other more serious skin health concerns.18 Hydroxytyrosol has been suggested in some research to reduce UVB ray-induced DNA damage to human skin cells, a result that led research to suggest it may have “significant protective ability” against photodamage to skin.19
